Case: Achin Gupta v. State of Haryana & Anr.

The Hon’ble Supreme Court of India in Achin Gupta v. State of Haryana & Anr., 2024 SCC OnLine SC 759, once again examined the growing concerns surrounding misuse of criminal proceedings arising out of matrimonial disputes.

The case involved allegations under matrimonial offences where the accused approached the Court seeking quashing of criminal proceedings on the ground that the complaint contained general and exaggerated allegations.

The Supreme Court observed that matrimonial cruelty is undoubtedly a serious offence and genuine victims must receive full protection under law. However, at the same time, criminal prosecution should not be permitted to become a weapon for harassment where allegations lack specific details.

The Court stated that courts must carefully examine whether accusations disclose actual criminal conduct or whether family members have been unnecessarily implicated due to personal disputes between husband and wife.

The judgment followed earlier principles laid down in cases dealing with misuse of Section 498A IPC and the necessity of preventing abuse of the criminal justice system.

The decision creates a balanced approach in matrimonial disputes. It protects genuine complainants while ensuring innocent persons are not subjected to prolonged criminal trials based on vague accusations.

The judgment continues to guide courts while exercising powers for quashing criminal proceedings arising from matrimonial conflicts.
