The dispute concerned interpretation of Section 23 of the Senior Citizens Act, which provides protection to elderly persons who transfer their property on the understanding that the transferee shall provide basic amenities and take care of their needs.
The Supreme Court observed that the purpose behind the legislation is to protect senior citizens from abandonment, neglect and exploitation. However, the Court clarified that every transfer of property made by a senior citizen cannot automatically be declared void merely because disputes subsequently arise between the parties.
The Court held that for invoking Section 23, there must be a condition attached to the transfer—express or capable of being established from circumstances—that the transferee was required to maintain and provide necessary care to the senior citizen. If such obligation existed and was violated, the transfer may be treated as void under law.
The judgment carefully balanced two important principles: protection of elderly persons from exploitation and preservation of certainty in property transactions.
This ruling provides important guidance in property disputes involving parents and children. It protects elderly citizens from being deprived of their assets after trusting family members while ensuring that genuine property transfers are not disturbed without legal justification.
